Re: The Buffalo Corporation, Debtor
Case No. 99-40876…
Dear Ladies and Gentlemen
So there may be an orderly transition, I am extending operation
for up to 1 week or up to October 22, 2001. During that time,
I request the park managers to provide to me a list of lessors
— those who have provided, for example, vending machines
and the like. Since this is not owned by the estate, I will
contact these persons to pick up their equipment unless the
mortgagee in question assumes responsibilities for that item.
Pease provide names, addresses and phone numbers.
I also request that each park manager provide to me a list
of members who have their rigs or other property stored on
the park so we can arrange for removal.
I will notify the utilities to discontinue service on or
before October 22nd. If a mortgagee, or Intrepid wishes to
continue the service at its expense, please notify me as
soon as possible.
I recommend to the mortgages and Intrepid that you maintain
security at your respective park by retaining the current
personnel. You will be responsible for payment of their salaries
from October 22nd. Please let me know of your decision. If
you retain the employees, you will be responsible for giving
direction to these employees. If you are unwilling to retain
these employees, I request the park managers to secure all
property, lock all buildings and chain lock the entrances.
At the present, Ms. Stafford has filed a motion to lift the
stay to foreclose which will be heard on October 23rd. Unless
something happens, i.e. a purchase offer, I shall not oppose
it. I anticipate a like motion from Mr.McPhail. Again, unless
something happens, I shall not oppose it. As for Scenic Trails,
I will broach a proposal to Hancock Bank either today, if
I can get into the office before having to leave town, or
the first thing Tuesday. As for Country Creek, we have a
trial set for October 26th as to which of Intrepid or I,
as Trustee, own Country Creek. If I own it, I will sell the
property. It will not be re-opened as a park unless I receive
some financial assistance to operate. I am negotiating the
sale of the membership and will let you know how that progresses.
My efforts in that regard will continue past October 22nd
if necessary.
From the mortgages and Intrepid, please communicate your
intentions to me as soon as possible. |
