TAI Class Action Update
Douglas H. Napier, Attorney at Law
March 2002
Our law firm continues to make progress in the quest to recover
money for TAI members, stop various lenders from collecting contract
payments, and seeking ways to prevent Travel America from intimidating
TAI members.
We have recently settled with Great Western Bank and settlement
checks should be mailed out by mid-March.
If you were not included in the Great Western settlement, don't
despair as there are other defendants we are pursuing. A number
of defendants have shown a strong interest in settlement and we
have had very productive settlement negotiations with several
companies.
The settlement with Princap involved the sale of some real estate
in Oklahoma. The bankruptcy trustee is in the process of clearing
the title to the land so that it can be sold and the proceeds
can be distributed. The settlement proceeds coming to the TAI
members should be available to ALL TAI members. These funds will
be pooled with other settlements and will eventually be distributed
to the members. Be patient. This is a long, arduous process.
I have spent an enormous amount of time the last three months collecting
documents and evidence that will be used to prove our case against
the lender defendants. I have received cooperation from some unusual
sources and persons who have inside knowledge of TAI, Travel America
and various defendants. Their willingness to help the members
has proven very fruitful.
I want to encourage each member to search for all documentation
regarding your TAI membership, contract payments, and other proof
of payment to TAI, Travelers Data or any other entity.
This information may be needed in future settlements to entitle
you to monies.
PASS THE
WORD
I also want to urge you to get the word out to other TAI members
to register with the class, notify me of address changes, to "do
their homework" before sending any money to Travel America.
Let them know that Travel America and TAI have no legal connection
other than Travel America somehow obtained the list of members
and has chosen to bill TAI members for dues even though TAI members
have not signed up as members of Travel America.
If you have been contacted by Travel America for dues or contract
payments, been threatened with a lawsuit if you don't pay, or
paid money because they told you "had to pay" or made
any other representations that you believe are untrue, then I
want to hear from you.
Some of you have changed addresses since you last sent me
your information, remember - if I don't know how to get in
touch with you - is impossible for me to send you a check.
Notify me right away if you change your address so that I
can get in touch with you if I need more information or to
mail you a check.
I am collecting statements from people who have been harassed by
Travel America so that I can try to put a stop to their inappropriate
collection activities. An outline of
an affidavit is included in this newsletter for your assistance.
Make sure you only include information that is true and feel free
to add additional details and facts that you think would be helpful.
If you had paid money to Travel America that you believe you should
not have had to, then attach any evidence of payment that you
have.
I continue to be very optimistic about this case and continue to
strive to serve your interests.
Keep up the faith.
Sincerely,
Douglas H. Napier
